Delays and Partial Payouts — Challenging the Patience of Florida Policyholders

Insurers often engage in strategies meant to challenge the patience of the policyholder and thereby force the policyholder to accept a lower payout, or to simply resign themselves to no payout.  For example, an insurer may excessively delay the processing of the claim, arguing that the delays are due to ongoing investigation of the damage.  By doing so, they hope that you — under pressure to fix the roof and no doubt overwhelmed by the proceedings— will simply move forward without waiting for the insurer and potentially give up on dealing with the hassle they created.

Partial payouts — in which the policyholder is offered an inadequate sum, but a sum nonetheless — are another way in which insurers try to goad policyholders into accepting less than what they’re owed under the policy at issue.

It’s worth noting that Florida law may entitle policyholders to bring an independent “bad faith” action against the insurer (which could even lead to punitive damages) if the insurer failed to investigate and pay the claim in a timely manner, or failed to evaluate the claim fairly under the circumstances. Simply put, if there was no valid justification for the denial, then our Fort Lauderdale roof damage attorneys may be able to sue and recover damages pursuant to a bad faith claim.

Coverage Exclusion as the Basis for Denial

In homeowner’s insurance policies, payouts for roof damage may be limited due to coverage exclusions.

For example, a roof damage claim may be covered if it is caused by a thunderstorm, but not if it is caused by a hurricane.

Such strict categorization for roof damage coverage often leads to a dispute, particularly if the event leading up to the roof damage at-issue is somewhat muddled — if your roof is damaged in a hurricane (which is covered by the policy), the insurer might claim that it was not actually the wind force of the hurricane itself, but a falling tree that caused the roof damage.  You can successfully counter this argument by showing how the hurricane directly caused the tree to fall on your roof.

It is extremely important for you to have records of your property’s condition in the event that you need to file a claim with your insurance company.

Before The Storm:

  • Take photos of your property- Interior of Home, Exterior of Home, Roof, Pool and Pool Area, Fencing, Trees, Front Yard, Back Yard.
  • If you are not able to take photos before a storm, collect the most recent photos you have taken of your property.
  • Document belongings- with proper documentation, you may also be able to recover lost expenses for home contents, personal property, and other items. Here is a list of some items to consider keeping receipts for or appraising: Televisions, Furniture, Jewelry, Artwork, Appliances, Computers, Antiques, Beds, Decks, Other Electronic Equipment
  • Know what is in your homeowner’s insurance policy.
  • Have records of your property’s condition in the event that you need to file a claim with your insurance company.
  • Review your mold coverage.
  • Review your flood coverage. This is normally separate insurance policy.
  • Ask your insurance agent about coverage for water damage, law and ordinance, debris removal, and additional living expenses.
  • Check your hurricane deductible, it can be much higher than your regular deductible.
  • Have a plan to move yourself and your family – especially those with special needs.
  • Have a portable radio, TV or NOAA Weather Radio on hand to monitor important information.
  • Homeowners who depend on well water should draw an emergency supply.
  • Get cash or travelers checks in case banks or ATMs are not operational.
  • Ensure all your electronic/mobile devices are fully charged.
  • Gather important documentation and place in waterproof container.
  • Make arrangements for pets; emergency shelters may not let you bring your animals with you.
  • Find out where the nearest shelter is located and the routes to get there.
  • Fill your automobile(s) with gas or ensure your electric vehicle is charged.
  • If you have an emergency power source, learn how to use it properly.

After The Storm:

  • When it is safe to do so, photograph your property’s: Interior, Exterior, and Roof
  • Consult with an attorney experienced in handling insurance claims before giving any recorded statements or meeting with an adjuster assigned to the claim.
  • Call the insurance carrier and timely report the claim.
  • Homeowners should obtain an inspection by a qualified contractor and/or roofer to assess whether the hurricane force winds have damaged or diminished the roofing system and building envelope.
  • Take photos and record the questions and answers when talking to adjusters.
  • Make sure to keep track of the name and number of every person you talk to at your insurance company.
  • Check your Co-Insurance penalties.
  • Make a copy of the insurance policy and keep it in a safe place.
  • Check your policy coverages and sublimits.
  • Just because water has not began to enter the structure does not mean that there is not damage to their property.
  • We have seen too many homeowner claims where an engineer is hired months after the storm and the engineer states the damage preexisted the hurricane.

  • Businesses should pay close attention to the storm’s forecast over the weekend. The National Hurricane Center releases a new full advisory every 6 hours, at 5am, 11am, 5pm and 11pm EDT. They are issuing intermediate advisories every 3 hours, between the full advisories (1am, 8am, 1pm, 8pm EDT.)
  • During this time, it’s important to review your disaster and emergency communication plan.
  • Backup all data on servers and personal computers and ensure remote access is available.
  • Ensure your equipment is raised above potential flood levels.
  • Review your insurance policies to mitigate any possible gaps in coverage.
  • Protect and duplicate important business documents and records. Be sure they are accessible from anywhere.

Your house has an intricate network of plumbing and a burst pipe could lead to both major headaches and expensive repair bills. Not to mention other water problems, like a heavy storm, a deep freeze or even a busted hose on a dishwasher.

    Water damage (including damage from freezing) is one of the most common and most costly types of homeowners insurance claims. Every year, about one in 50 homeowners will file a water damage or freezing claim, accounting for almost 24% of all homeowners insurance claims, according to the Insurance Information Institute. The average cost of a water damage or freezing claim is about $10,900.
    One of the best ways to protect a home from water damage is by taking some preventative measures. Keeping up with routine maintenance and making prompt repairs is key.
    Remember, homeowners insurance covers water damage that is “sudden and accidental” but not gradual problems or maintenance issues. If you have a problem like a leaky faucet, it’s best to take care of it as soon as possible.
    Here are other steps you can take:
    Drain water heaters twice a year to help prevent sediment buildup.
    • Install smart water leak detectors that will send an alert to your phone or email. (Some detectors can
    automatically shut off the water to prevent damage). In a LexisNexis study of 2,306 U.S. homes that installed a water leak detector had water-related claims go down by 96% compared to the two years prior to installation.
    • Inspect hoses going to and from washing machines, dishwashers, water heaters and refrigerators. Repair or replace any damaged hoses if necessary.
    • Inspect your roof and make any necessary repairs, such as replacing missing, rotten or damaged shingles. It’s also a good idea to clean out your roof gutters. Clogged gutters can overflow and allow water to pool near a home’s foundation, which could seep into your basement.
    • Prevent frozen pipes if you live in an area that has extreme cold temperatures. Keep your heat set to at least 50 degrees and consider other precautions, like wrapping pipes with insulation.
